Regulations for Landlords

Certificates for landlords cover all the legally required certificates required by the Scottish Government.

One important document is the Legionnaires Disease, Health and Safety legislation.
Landlords are required to ensure their rental properties have undergone a legionella safety check. This must be carried out by a competent person who will supply a completed report of the assessment.
This will also flag up any potential risks with the boiler and any stored water.

This is an important statement we received from one of our EPC lodging partners regarding he status of Energy Performance certificates after the Referendum of last week.

Elmhurst would like to confirm that as it stands no changes have been made to legislation and therefore the requirement for Energy Performance Certificates (EPCs), Display Energy Certificates (DECs) and Air Conditioning Certificates (ACI) all remain unchanged and anyone who fails to comply with the legislation is likely to face fines and penalties.

In a press statement we have stated that:
Elmhurst Energy believes that the EU has been good for energy efficiency, but it is obvious that issues of the economy and immigration had a greater impact on the outcome and we urge MPs not to ‘throw the baby out with the bath water’ and instead give careful consideration to the benefits that have been gained from the Energy Performance of Buildings Regulations before making any changes.
In December 2015 the United Kingdom (UK)
signed the international Paris Treaty with the United Nations (UN), which committed it to demanding a long-term reduction in carbon emissions. As approximately 30% of carbon emissions in the UK come from the buildings we occupy, this is an area that deserves close scrutiny, careful measurement and a long-term government strategy to facilitate improvement and the subsequent social benefits in health and welfare that come from taking people out of fuel poverty.
Energy rating is not an invention of Europe and has been used to assess UK building stock for many years, and will continue with or without Europe. The Standard Assessment Procedure (SAP), the reduced version (RdSAP) and Simplified Building Energy Model (SBEM) were invented in the UK for UK buildings and climate conditions.

The Government will still need policies and tools to enable the UK to use less energy and save people money. Consumers now expect information on everything they buy and buildings are no different. That demand will remain
.

If your thinking of renting your property, here's a list of the documents you will be required to have.


 
Landlord Certificate Checklist
 Must be renewed every 10 years or if there have been any changes made to the property, ie, new boiler, insulation measures etc)
 If the property has a mains fed boiler ie: Combi and no water storage tanks, this certificate should be updated every 2 years.  For Properties which have cold water and Hot water storage this certificate should be updated every year.
3.       EICR Certificate (Electrical Installation Condition report) this report must be carried out every five years or at the change of each tenancy.
4.       PAT (portable appliance testing) this should be carried out annually.
5.       Gas safety certificate. This needs to be carried out annually.
Legislation is constantly changing. Please keep your certificates up to date.

EPC Irvine

Please be aware of online companies offering you EPC, Legionella risk assessment at knock down prices. These operate on a call centre basis, taking your money before you have a surveyor call at your property. We are finding more and more of these companies use freelance surveyors to carry out the work. Unfortunately the surveyors never get paid by these companies.

Certificates for landlords are a local company covering, Glasgow, Renfrewshire, Irvine, Saltcoats, Kilwinning, Irvine etc. We never take deposits over the telephone or online and only charge when the work has been completed.

Energy Performance Certificate


Example of an Energy Performance CertificateThe EU Directive on the Energy Performance of Buildings came into effect progressively from 2007 and is an important part of government strategies for tackling climate change. The principle underlying the Directive is to make energy use in buildings transparent by the issuing of a certificate showing the energy rating of a property, accompanied by recommendations on how to improve efficiency. This energy performance certificate (EPC) must be provided whenever a property is constructed, rented out or sold. The EPC shows the energy efficiency rating (relating to running costs) of a dwelling. The rating is shown on an A–G rating scale similar to those used for refrigerators and other electrical appliances.

When the construction of a new building is completed, the builder or person responsible for the construction is responsible for obtaining the certificate and providing it to the owner. This is a duty under Building Regulations. This will also apply if a building is converted into fewer or more units and there are changes to the heating, hot water provision or air conditioning/ ventilation services.
Domestic properties require an EPC on construction and some commercial buildings will require an EPC on construction or conversion.

An assessment will include; the name and competencies of the person responsible for the assessment and of the person managing the system, a description of the system, identify potential risks, identify any means of preventing the risk or recommendations to control risks, suggestions for monitoring results, checks and frequency of testing.http.www.certificates4landlords.com

Landlords and Legionella


As a Landlord you have a responsibility to understand and minimise the risks from Legionella in your properties. This means complying the relevant section (in chapter 3) of the Health and Safety at Work Act 1974. The Health and Safety Executive clearly states that if you are ‘someone in control of premises, including landlords, you must understand the health risks associated with legionella.’
The Approved Code of Practice: Legionnaires’ disease: The control of Legionella bacteria in water systems (L8) contains guidance on how to manage and control the risks in your system and can be found on the HSE website.

Landlords have a legal responsibility to ensure a risk assessment of the property is carried out by a competent person who has knowledge of Legionella and water systems and is up to date with the latest legislative changes. Following the findings of the report it is the Landlord’s responsibility to manage any risks, prevent or control any risks, keep and maintain correct records and carry out any other associated duties. Landlord Certificates.

What are EPCs?

Energy Performance Certificate (EPC) imageMuch like the multi-coloured sticker on new appliances, EPCs tell you how energy efficient a building is and give it a rating from A (very efficient) to G (inefficient). EPCs let the person who will use the building know how costly it will be to heat and light, and what its carbon dioxide emissions are likely to be.
The EPC will also state what the energy-efficiency rating could be if improvements are made, and highlights cost-effective ways to achieve a better rating. Even if you rent your home, some improvements noted on the EPC may be worth implementing, such as switching to more energy-efficient light bulbs.
